Terms of service
General Terms and Conditions (GTC)
1. Scope
These General Terms and Conditions apply to all orders concluded via the Stealth Campervan online shop.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.
An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the course of their commercial or self-employed professional activity.
2. Contracting party
The purchase contract is concluded with:
Stealth Campervan
Owner: Norman Kriese
Am Sandberg 80
60599 Frankfurt am Main
Germany
Email: info@stealth-campervan.com
3. Ordering process and conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
The customer can place the desired products in the shopping cart and review and correct their entries before submitting the order.
By submitting the order using the button provided for this purpose, the customer makes a binding offer to conclude a purchase contract for the goods contained in the shopping cart.
An order confirmation sent automatically immediately after receipt of the order initially merely documents receipt of the order and does not yet constitute acceptance of the offer unless acceptance is expressly declared in it.
The contract is concluded as soon as we expressly confirm the order, collect the payment or initiate the payment process, or dispatch the goods – whichever of these events occurs first.
The order data is transmitted to the customer electronically after the order has been completed. The General Terms and Conditions applicable at the time can be accessed, saved and printed via the online shop before the order is submitted.
4. Prices and shipping costs
The prices stated in the online shop include the applicable statutory VAT where such VAT applies.
Any additional shipping costs are shown separately during the ordering process.
For deliveries to countries outside the European Union, additional customs duties, import VAT or other charges may arise. These are not charged by Stealth Campervan and must be borne by the customer unless otherwise required by law.
5. Delivery and shipping
Delivery is made to the delivery address specified by the customer during the ordering process.
The available delivery areas, shipping costs and expected delivery times are set out in the information provided in the online shop and in the shipping information.
For consumers, the risk of accidental loss or accidental deterioration of the goods generally passes only when the goods are handed over to the consumer or to a recipient designated by the consumer.
For entrepreneurs, in the case of a sale involving shipment, the risk passes to the buyer when the goods are handed over to the company commissioned to carry out the transport, insofar as legally permissible.
6. Payment
The payment methods displayed in the online shop or at checkout are available.
Unless otherwise stated for the selected payment method, the purchase price is due upon conclusion of the contract.
When external payment service providers are used, their respective terms and conditions may apply in addition.
7. Retention of title
The delivered goods remain the property of Stealth Campervan until the purchase price has been paid in full.
8. Right of withdrawal for consumers
Consumers generally have the statutory right of withdrawal for distance contracts.
Details regarding the requirements, deadlines, consequences and exercise of the right of withdrawal are set out in the separate withdrawal policy of our online shop.
Entrepreneurs do not have a statutory consumer right of withdrawal.
9. Rights in the event of defects and warranty
The statutory rights in the event of defects apply.
For consumers, the statutory limitation period for claims relating to defects in new goods is generally two years from delivery of the goods. Statutory special provisions, in particular regarding extension, suspension or recommencement of limitation periods, remain unaffected.
For entrepreneurs, the statutory provisions regarding rights in the event of defects and limitation periods apply.
If the buyer is a merchant within the meaning of the German Commercial Code (HGB), the statutory duties of inspection and notification of defects also apply.
An additional guarantee exists only if such a guarantee has been expressly given for the respective product. Statutory warranty rights are not restricted by any such guarantee.
10. Liability
Stealth Campervan has unlimited liability:
in cases of intent and gross negligence,
for damage resulting from injury to life, body or health,
under the mandatory provisions of product liability law,
and to the extent of any guarantee expressly assumed.
In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical of the contract. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the contracting party may regularly rely.
In all other respects, liability for damage caused by slight negligence is excluded insofar as legally permissible.
The above limitations of liability apply accordingly in favour of our legal representatives and vicarious agents.
11. Special provisions for entrepreneurs
If the customer is an entrepreneur, the statutory provisions of commercial law also apply insofar as applicable.
Entrepreneurs do not have a statutory consumer right of withdrawal.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationship shall, insofar as legally permissible, be Frankfurt am Main.
12. Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the state in which the consumer has their habitual residence.
13. Final provisions
If any provision of these General Terms and Conditions is or becomes wholly or partially invalid, the remaining provisions shall remain unaffected.
The statutory provisions shall apply in place of any invalid provision.
